Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and AtlasAdapt LLC ("AtlasAdapt", "we", "us" or "our"), a limited liability company based in Orlando, Florida, USA. They govern your access to and use of atlasadapt.com (the "Site") and our interactive demonstration and estimation tools (the "Demo"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site. These Terms are published in English; where we make translations available, they are provided for convenience only and the English-language version prevails in the event of any conflict.

1. Who may use the Site

The Site is intended for business users who are at least 18 years old and able to form a binding contract. If you use the Site on behalf of an organisation, you represent that you are authorised to accept these Terms for it.

2. What we provide

AtlasAdapt offers an informational website and interactive tools that model property resilience, natural-hazard exposure, upgrade costs and savings, insurance considerations and government or utility incentives, using public data sources and modelling assumptions. The Site is provided free of charge and does not currently offer paid accounts, subscriptions or transactions.

3. Estimates only — not professional advice

All figures, ratings, incentive amounts, insurance and premium indications, risk levels, costs, savings and payback periods shown on the Site or in the Demo are illustrative ESTIMATES generated from third-party and public data and general assumptions. They are provided for information only and are NOT financial, insurance, tax, legal, engineering, surveying or other professional advice, and are not an offer, quote, guarantee or promise of any incentive, saving, coverage or outcome. Incentive programs, eligibility rules, funding and hazard data change frequently and vary by property and circumstance. You must independently verify any figure — and consult a qualified professional and the relevant program, insurer or authority — before relying on it or making any decision. To the fullest extent permitted by law, we accept no liability for decisions made in reliance on the Site.

4. Third-party data

The Site incorporates data from third parties and government sources (including FEMA, the U.S. Census Bureau and the U.S. Energy Information Administration). This data is provided "as is", may be incomplete, out of date or inaccurate, and we do not control or warrant it.

5. Acceptable use

You agree not to:

• use the Site unlawfully or in breach of these Terms;
• copy, scrape, harvest, resell or systematically extract content or data from the Site except as expressly permitted;
• reverse engineer, interfere with, overload, or attempt to gain unauthorised access to the Site, its APIs or underlying systems;
• introduce malware or misuse the contact form or any interactive feature; or
• use the Site to infringe the rights of others.

6. Intellectual property

The Site and its content — including text, design, graphics, logos, software and the AtlasAdapt name and marks — are owned by or licensed to AtlasAdapt and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for your internal business evaluation. All other rights are reserved.

7. Your submissions

If you send us information through the contact form or otherwise, you confirm it is accurate and that you are entitled to share it, and you grant us the right to use it to respond to and manage your enquiry. Please do not send us confidential or sensitive information you do not wish us to process.

8. Disclaimer of warranties

The Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure, or that any content or estimate is accurate or complete.

9. Limitation of liability

To the fullest extent permitted by law, AtlasAdapt and its members, officers, employees and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, business or goodwill, arising from or related to your use of (or inability to use) the Site or reliance on any estimate, even if advised of the possibility. Our total aggregate liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US$100). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

10. Indemnification

You agree to indemnify and hold harmless AtlasAdapt from any claims, losses and expenses (including reasonable legal fees) arising out of your misuse of the Site or breach of these Terms.

11. Third-party links

The Site may link to third-party sites and resources that we do not control. We are not responsible for them, and access is at your own risk.

12. Changes and availability

We may modify, suspend or discontinue any part of the Site at any time, and may update these Terms from time to time. Changes take effect when posted, with an updated effective date. Your continued use after changes means you accept them.

13. Termination

We may suspend or terminate your access to the Site at any time if you breach these Terms or misuse the Site.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Orange County, Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Site, and you consent to their jurisdiction and venue, except where mandatory local law gives you other rights.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms are the entire agreement between you and us regarding the Site.
